Counsel for the petitioner submits that correct facts could not be brought to the concerned Labour Court as ex-parte proceedings were undertaken against them. The exparte proceedings were undertaken on record on account of afflux of time and on account of not having any information about the concerned dates.
I have examined the award and finds that the Officer-incharge who was appointed to contest on behalf of the petitioner shows his complete afflux and appears to by default support the case of the respondents while granting liberty to the petitioner to move appropriate application for setting aside the exparte award. It is also directed that appropriate action be taken against the concerned officer-in-charge and the same should be reported to

the concerned labour court who will look into for deciding the said
application.
With aforesaid observations, the writ petition is disposed of.
