The present misc. petition has been filed by the petitioner against the orders dated 20.05.2019 & 01.07.2019 passed by the learned Magistrate, Gram Nyayalaya, Mandore, District Jodhpur by which he declared the petitioner as absconder and issued permanent standing warrant against the petitioner and ordered to initiate the proceedings under Sections 446, 82-83 Cr.P.C.

Counsel for the petitioner has made a limited prayer that the arrest warrant so issued against the petitioner may be converted into bailable warrant and the petitioner is ready to appear before the trial court and in future he will attend each and every date fixed in the matter by the trial court.

Learned Public Prosecutor opposed the prayer made by the petitioner.

Heard the learned counsel for the parties.

In view of the limited prayer made by the petitioner and taking into consideration the facts that the petitioner is facing trial for offence under Sections 304A, 338, 337, 279 IPC and the petitioner did not appear on 01.07.2019 before the trial court and now he is ready to appear before the trial court, I deem it appropriate to covert the permanent standing warrant into the bailable warrant subject to deposition of cost of Rs.5,000/- before the trial court.

Accordingly the permanent standing warrant so issued by the trial court is hereby converted into bailable warrant of Rs.30,000/subject to deposition of cost of Rs.5,000/- before the trial court. The petitioner is directed to appear before the trial court on or before 25.11.2019 and submit bail bonds of Rs.30,000/-.

The misc. petition is disposed of accordingly.
