Petitioners have preferred this Criminal Miscellaneous Petition seeking quashing of proceedings in Criminal Case No.10/2018 (4/2016) pending before learned Additional Sessions Judge No.18, Jaipur Metropolitan.

It is contended by counsel for the petitioners that parties are related to each other and are residing in the same area. A compromise was effected between the parties and the same was filed before the Court below. Court has compounded the offence under Sections 341 and 323 of IPC but as remaining offences were non-compoundable, the same were not compounded.

Counsel for the petitioners has placed reliance on Yogendra Yadav And Ors. vs. State of Jharkhand And Anr. , 2014 Cr.L.R. (SC) 1258 and Leelaram And Ors. vs. State of Rajasthan And Ors. , S.B. Criminal Misc. Petition No.5292/2019 decided by this Court on 27.08.2019.

Counsel for the complainant and victim has not disputed the fact of parties having entered into compromise. He has no objection to the quashing of the proceedings.

I have considered the contentions.

In view of the fact that parties are related to each other and are neighbors, the present Criminal Miscellaneous Petition is allowed and proceedings in Criminal Case No. 10/2018 (4/2016)
