Petitioner has preferred this Criminal Misc. Petition for quashing of Criminal Case No.506/2016 qua the petitioner.

It is contended by counsel for the petitioner that co-accusedKamlesh joined her school on 19.07.2007 and cleared her Eighth Class Examination on 30.04.2008. It is contended that petitioner has not forged in document and Kamlesh had actually studied in her school and she has given certificate as per the school record and the certificates were factually correct.

I have considered the contentions and have gone through the charge-sheet.

The Police after due investigation has come to the conclusion that Kamlesh is an illiterate lady, who has not studied. The Police

has also come to the conclusion that she had obtained the certificate to context the election of Sarpanch. It is also come in the investigation that Kamlesh even is not in a position to properly sign.

In view of the fact that the Investigating Officer has come to the conclusion that Kamlesh is an illiterate lady and forged certificate was issued by the petitioner, no ground is made out for entertaining the Criminal Misc. Petition for quashing of Criminal Case No.506/2016 qua the petitioner.

The Criminal Misc. Petition is accordingly dismissed. Stay application stands disposed.
