Petitioner has filed this third bail application under Section 439 of Cr.P.C.

F.I.R. No. 1472/2016 was registered at Police Station Kotwali, Alwar for offence under Sections 420, 409, 467, 468, 471 and 120-B of I.P.C. and Section 66-C and 66-D of I.T. Act.

It is contended by counsel for the petitioner that case of petitioner is akin to that of other co-accused who have been given benefit of bail. No amount was transferred to the account of petitioner. Petitioner was merely an employee of the bank. Cashier Tika Ram and accountant Suresh Chand Sharma were given benefit of bail and after rejection of the second bail Deepak Kumar has also been enlarged on bail by Co-ordinate Bench of this Court. Case of petitioner is on a better footing than that of Deepak

I have considered the contentions.

Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the third bail application.

This third bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when
