These second bail applications under Section 439 Cr.P.C are laid by petitioners in connection with an FIR, wherein they are charged for offences punishable under Sections 302, 307, 325, 323, 147 & 149 IPC.

First bail application of petitioners bearing Criminal Misc. Bail No.7523/2017 was dismissed on 01.09.2017.

Arguing on these second bail applications, learned counsel for the petitioners submits that after rejection of first bail application there is substantial change in the circumstances inasmuch as co-accused Gurlal Singh S/o Balvinder Singh @ Palvinder Singh has already been enlarged on bail and the case of the present petitioners is not distinguishable from the co-accused.

Learned Public Prosecutor has opposed the bail application.

Having heard learned counsel for the parties and taking into account facts and circumstances of the case, without expressing any opinion on merits of the case, I deem it just and appropriate to grant indulgence to the petitioners by enlarging them on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that accused-petitioners (1) Manpreet Singh S/o Sh. Ratan Singh, and (2) Jassa Singh @ Jaswant Singh S/o Darshan Singh arrested in connection with F.I.R. No.78/2017, Police Station Chunawad, District Sri Ganganagar may be released on bail; provided each one of them furnishes a personal bond of Rs.1,00,000/- with two surety bonds of Rs.50,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
