Petitioner has filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 535/2016 registered at Police Station Malakhera, District Alwar for offence under Sections 341, 323, 324, 302/34 of Indian Penal Code, 1860.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 04.12.2016. Wife of the petitioner is having cyst in her uterus and has been advised to undergo an operation. Petitioner be granted interim bail for one month to enable him to get his wife operated.

Learned State counsel who is assisted by counsel for the complainant has opposed the petition.

Learned State counsel has placed on record the report submitted by the Station House Officer, Malakhera, District Alwar and as per the same, wife of the petitioner has to undergo an operation on 10.04.2019.
