S.B.Crim. Misc. Application No.7239/2018:-

Letter has been received from the Additional District & Sessions Judge, No.2, Hindaun City giving explanation for the delay in completing the trial.

From the letter it is apparent that a casual approach has been adopted in giving dates ignoring with the order passed by this Court.

This Court vide order dated 25.06.2018 had directed to complete the trial expeditiously but not later than six months. From the report/letter sent by the Additional District & Sessions Judge No.2, Hindaun City dated 15.01.2019 it is apparent that the dates for recording evidence have been fixed after 18.07.2018 to 30.08.2018 and then 18.09.2018 and then 24.10.2018 and thereafter 16.11.2018, 14,12,2018 09.01.2019 and 24.01.2019. 4. I find that dates are being given for recording evidence after 20 days to one month which was not warranted in a case registered under Section 304B, 201 & 176 IPC. Recording evidence of prosecution witnesses who are available, should be done at the earliest, Dates should not have been given for more than 10 days. All the more when the accused is in jail since 23.08.2015 and almost 3-1/2 years has gone by.

I am not satisfied with the explanation coming forward by the Additional District & Sessions Judge, No.2, Hindaun City. However, in the interest of justice he is given another 60 days time to complete the trial.

Copy of this order be also sent to the Registrar General for administrative purposes.
