Learned counsel for the applicant submits that no role has been assigned to the applicant in the incident. Accused who alleged to have used fire-arm along with other co-accused has been acquitted as the witnesses did not support prosecution story.
Learned Public Prosecutor and counsel for the complainant opposed the bail application and submitted that applicant remained absconder for a long period and did not co-operate with the investigation. Learned PP further submitted that as per criminal antecedents, applicant was found involved in three other cases.
Taking note of the seriousness of allegation levelled against the applicant, no ground for grant of anticipatory bail to the petitioner is made out.
Accordingly, the misc. bail application is dismissed.
