Appellants have filed this appeal under Section 14-A of The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 seeking regular bail in F.I.R. No. 138/2014 registered at Police Station Beawar City Ajmer for offence under Sections 143, 323, 354, 452 of Indian Penal Code, 1860 and Section 3(1)(V)(X) (XI) of The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Learned counsel for the appellants has submitted that, although, appellants had jumped bail on 17.11.2018 but now they are in custody since 09.01.2019. Appellants had moved an application before the Trial Court for converting their non bailable warrants into bailable warrants, but the same was dismissed and thereafter they had moved a petition under Section 482 Code of Criminal Procedure, 1973 before this Court and the same was disposed of vide order dated 19.12.2018 (Annexure-3). In pursuance to the Annexure-3, petitioners surrendered before the Trial Court and they were arrested and their bail petition was rejected.

Learned State counsel has opposed the appeal.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the appellants on bail.

Accordingly, without expressing any opinion on the merits of the case, this appeal is allowed. Appellants be admitted to bail subject to satisfaction of the Trial Court.
