“It is submitted by the learned counsel for the defendant-appellant that as the disputed land is not still recorded in favour of the defendant-appellant as Khatedar, the sale-deed in respect thereof cannot be executed and the plaintiff-respondent is free to get the sale-deed executed in his favour according to the judgment under appeal.
In view of this statement of the learned counsel for the appellant, there is no question of any stay.
Consequently, the stay application is filed.”
