Heard learned counsel for the accused-petitioner as well as learned Public Prosecutor and counsel appearing for the complainant on the application for suspension of sentence.

Learned counsel for the petitioner submits that the accused petitioner is in custody since 5.1.2018. Counsel submits that the accused-petitioner was on bail during trial and also during pendency of appeal. There is no criminal antecedents against him.

The petitioner has been convicted for the offence under

Section 10 of Rajasthan Gunda Control Act, 1973 and sentenced with a maximum of two years rigorous imprisonment along with fine as per judgment dated 5.1.2018.

Learned Public Prosecutor has vehemently opposed the

prayer.

Without commenting upon the merits of the case and looking to the above facts and circumstances of the case, I deem it just and proper to suspend the sentence awarded to the accused-petitioner.

Accordingly, the bail application for suspension of sentence is allowed and it is ordered that the sentence passed by learned trial court and affirmed by the learned Additional Sessions Judge No.6, Jaipur Metropolitan vide his judgment dated 5.1.2018 passed in Criminal Appeal No.8/2016 against the accusedpetitioner Babu Lal Chhipa S/o Shri Kanhaiya Lal, B/c Chhipa shall remain suspended till final disposal of present petition provided he execute a personal bond in the sum of Rs.40,000/- along with two sureties in the sum of Rs.20,000/- each to the satisfaction of the trial court for his appearance in this Court on 15.6.2018 and, as and when called upon to do so.
