Learned counsel for the applicant has submitted that sentence qua co-convict Pratap Singh has been suspended by this court vide order dated 20.12.2017. Case of the applicant is on similar footing. Case property (residue contraband) was not produced before the trial court during trial.
Since sentence of co-convict has already been suspended by this court and applicant is in custody since December, 2011, application is allowed Sentence of the applicant shall remain suspended during the pendency of the appeal. Applicant be admitted to bail subject to satisfaction of the Trial Court.
