This appeal is directed against the order dated 31.05.2018 passed by the Single Bench of this court directing the provisional affiliation of the respondent institution for its ‘B.A., B.Ed. Four Years Integrated Course’ for one unit (50 students).

The learned counsel for the respondent submits that the admissions pursuant to interim order impugned in the present

appeal, directing provisional affiliation of the respondent samiti may not be granted as the counselling for admission is already over and the respondent, therefore, do not intend to avail any benefit of the impugned order. However, he requests that the learned Single Judge may be requested to decide the writ petition at an early date so that issue is decided on merits finally before commencement of the next academic session.

The learned counsel for the respondent has submitted that the order of this Court cited by the learned counsel for the appellant directing provisional affiliation, could not be passed.

Having regard to the submissions made by the learned counsel for the respondents, the impugned order dated 31.05.2018 is set aside. However, we request the learned Single Judge to dispose of the main writ petition itself on merits at the earliest.

The appeal is accordingly disposed of. This also disposes of the stay application.
