This writ petition has been filed by the petitioner with the

following prayers:-

“(I) by appropriate writ order or direction direct the respondents No.1 to 5 be directed to remove/ demolish the unauthorized or illegal construction of a multistory commercial building which is being constructed in ward No. 4, Village Mandawa District

Jhunjhunu.

(ii) by appropriate writ order or direction the sale deed dated 07.10.2014 executed in favour of the respondent No. 6 may kindly be declared as ab-initio void,

(iii) The respondents be restrained from regularizing of illegal and unauthorized construction in town Mandawa District Jhunjhunu and may kindly be declared all the permissions/orders (if any) which is against the Rajasthan Municipalities Act, 2009 as well as Regulation 2010 and against the Master Plan drafted for the Mandawa District Jhunjhunu and may kindly be directed to implement the master plan;

(iv) Any other relief which this Hon'ble court deems just and proper in the facts and circumstances of the case may also be given in favour of the Petitioner.”

Counsel for the petitioner submitted that respondent No. 6 has constructed the building unauthorisedly and without approved plans and has also encroached over the government land. Counsel further submits that in this regard he has also submitted a representation to respondent No. 5 but no action has been taken by the Municipal Board against the illegal construction.

In that view of the matter, I deem it proper to direct the respondent No. 5 to look into the matter and representation submitted by the petitioner in this regard be decided by a reasoned and speaking order within a period of one month.

The writ petition stands disposed of.
