Matter comes upon I.A. No.2429/2018 laid on behalf of petitioners under Article 226 of the Constitution of India for disposal of writ petition by issuing necessary directions to respondents to implement judgment and order dated 08.05.2017 (Annex.15), passed by Rajasthan Civil Services Appellate Tribunal qua them.

It is inter-alia averred in the application that the subject matter of instant writ petition and the grievance of the appellants before Tribunal were identical, and the learned Tribunal, while considering the grievance of the appellants therein, issued directions which are reproduced, in vernacular, as under:

It is also averred in the application that the judgment and order passed by learned Tribunal is implemented qua 94 persons who were appellants before the Tribunal and an order to this effect is passed by Dy. Commissioner of Police, Head Office, Commissionerate of Police, Jaipur. Learned counsel for the petitioners has also referred to a circular No.j-

9(4)/iqfyl/,/fujh/2016/ikVZ-I 2769-2850 dated 28.06.2018 issued by Director General of Police of Rajasthan, to proceed with the review process of promotion on the post of Head Constable.

There remains no quarrel that the decision has been taken at the level of Director General of Police to implement the judgment and order passed by the Tribunal qua some of the incumbents, and other incumbents working at different places are being singled out including the petitioners.

In view thereof to maintain parity and uniform implementation of circular dated 28.06.2018, the instant writ petition is disposed of with the direction to the respondents to implement the judgment and order passed by learned Tribunal in letter and spirit vis-a-vis petitioners as per availability of actual vacancies of the year concerned.
