The instant writ petition has been filed by the petitionerinstitution against the order dated 23.03.2017 whereby the Northern Regional Committee (to be referred as NRC) has rejected the petitioner-institution’s application for grant of recognition to its B.Ed. Siksha Shastri course.

Admittedly, the said order of refusal is appealable under Section 18 of the National Council for Teacher Education Act, 1993 (hereinafter referred to be as the Act of 1993).

In the circumstances, I am not inclined to exercise the extraordinary equitable jurisdiction of this Court under Article 226 of the Constitution of India against the order of refusal passed by the NRC. However, the petitioner-institution is at liberty to avail

the remedy of statutory appeal provided under Section 18 of the Act of 1993.

If the petitioner-institution files an appeal under Section 18 of the Act of 1993 before the concerned Appellate Authority, it is expected of the Appellate Authority to decide the same preferably within a period of two months.
