registered on 29.01.2013. The petitioner purchased only 12 bighas 2 biswas out of the total chunk of land, whereas the remaining part was purchased by the other two persons. Owing to some disputes with the Khatedar, the sale deed executed in favour of the petitioner was reversed by another sale deed executed by the petitioner in favour of Shri Ganga Singh and Shri Chhotu Singh on 26.09.2013. The Sub-Registrar issued a notice for charging deficit stamp duty to the tune of Rs.3,60,000/- on the agreement to sale executed between the petitioner and the Khatedar, i.e. Shri Ganga Singh. The petitioner claims to be residing at Jodhpur and since the notice was addressed to Balesar, he denies having received any such intimation. Thereafter, the Collector (Stamps), acting on a reference made by the SubRegistrar proceeded to pass the order dated 13.06.2014 (Annex.6) requiring the petitioner and Shri Ganga Singh to deposit the deficit stamp duty and penalty to the tune of Rs.3,61,000/-. In furtherance of the said order, the Collector (Stamps) issued auction notices for the entire 36 bighas of Khatedari land and forwarded the same to Mr. Nawab Khan, one of the purchasers. The order dated 13.06.2014 and the auction notices issued by the Collector (Stamps) to Mr. Nawab Khan are assailed in this writ petition.
