“The prayer in the present petitions is to set aside the order dated 21.11.2012 and order dated 04.06.2013 passed by the Board of Revenue rejecting the reference with a further prayer that the reference for cancellation of regularization of the possession of private respondents over the Gochar/Oran/Charagah land in question may be allowed and the regularization in favour of the private respondents may be cancelled.
Learned counsel for the respondent State has brought to the notice of this Court the order dated 05.01.2016 passed by Division Bench in the case of Om Prakash & Ors. Vs. State of Rajasthan & Ors. vide which the writ petition filed in public interest to remove the encroachments made on the same land which is a subject matter of the present writ petitions bearing Khasra Nos. 261 and 269 of Village Panditon-ka-Bas, Gram Panchayat Barnau, Panchayat Samiti Balesar, District Jodhpur was dismissed on the basis of a notification dated 17.06.2003 vide which the nature of the land in question was changed and there was no impediment in its allotment or for development of urban population.
Accordingly, the present writ petitions are dismissed in terms of the judgment rendered by the Division Bench in the case of Om Prakash & Ors. (supra).”
