Mr. Anurag Sharma the learned Additional Advocate General has very fairly admitted that similar prayer on facts and law which is akin to the present petitions has been decided by the co-ordinate Bench at Principal Seat at Jodhpur in State of Rajasthan vs. Manjeet Singh, Cr. Writs (CRLW) No. 31 of 2016 and it further submitted that the Special Leave Petition (Criminal) filed against the said order has been dismissed by the Supreme Court on ground of delay. It is contended that since the plea raised by the State has been declined, and same impliedly stands affirmed by the Supreme Court, the present petitions be dismissed as not pressed.
Ordered accordingly.
