This criminal revision petition has been filed on behalf of the petitioner being aggrieved with the order dated 28.2.2018 passed by the Special Judge, NDPS Act Cases, Jodhpur (for short ‘the trial court’) in Criminal Misc. Case No.36/2018 whereby, the trial court has dismissed the application preferred on behalf of the petitioner for terminating the proceedings initiated against him under Section 82 Cr.P.C. and to cancel the standing warrant of arrest issued against him.

The trial court has taken into consideration the fact that the police got issued arrest warrant against the petitioner under Section 37 of the Police Act by the trial court but the said arrest warrant has not been served upon him, then, the trial court vide orders dated 1.8.2017, 26.8.2017, 3.10.2017, 30.11.2017 and 31.1.2018 has extended the date of arrest warrant, however, after

taking into consideration the report made by the process server and after recording his statement, the trial court has declared the petitioner as absconder and has also ordered for issuance standing warrant of arrest against him and for initiation of proceedings under Section 82 Cr.P.C.

The trial court after taking into consideration the overall facts and circumstances of the case has refused to terminate the proceedings against the petitioner under Section 82 Cr.P.C. and has also refused to cancel the standing warrant of arrest issued against him.

Having heard learned counsel for the parties and after going through the impugned order, I do not find any illegality in the same.

Hence, this criminal revision petition being bereft of any force is hereby dismissed.
