Petitioner has filed this petition challenging the order dated 12.1.2017, whereby maintenance to the tune of Rs. 700/- per month has been granted to the respondents.
I have heard the learned counsel for the petitioner and have gone through the record available on the file carefully.
Petitioner was married to respondent No.1 on 18.4.2000. Out of the said wedlock, respondent No.2 was born. Respondent moved an application under Section 125 Code of Criminal Procedure, 1973 against the petitioner seeking maintenance. Provision, under Section 125 of the Code of Criminal Procedure, has been incorporated to protect deserted wives and children from vagrancy and to provide them speedy maintenance. Trial Court has granted maintenance to the tune of Rs. 300/- per month to
respondent No.1 and Rs. 400/- per month to respondent No.2. Keeping in view the high prices in these days, the said amount cannot be said to be on a higher side. Trial Court has passed the impugned order after considering the evidence led by the parties on record.
No ground for interference is made out.
Dismissed.
