The learned counsel for the petitioner has contended that during the pendency of the present petition seeking quashing of FIR, since the investigating agency has filed the charge-sheet, the present petition be dismissed as withdrawn with liberty to the petitioner to raise all arguments available to him before the trial court at appropriate stage.
