This petition under Section 482 Cr.P.C. is filed by accusedpetitioner for recalling order dated 21.11.2016, whereby his earlier Misc. Petition bearing No.2407/2016 was dismissed in default and for want of prosecution.
The petition is pending since January, 2017. On 22.08.2017, none was present for the petitioner, and therefore matter was deferred for four weeks. Again, on 20.09.2017 nobody was present. Likewise, on 05.12.2017 also, nobody was present for the petitioner. Today, when the matter is called out, nobody is present for the petitioner.
In this view of the matter, the instant petition merits rejection in default and for want of prosecution and the same is accordingly rejected.
