The application (APPLR No.402/2018) preferred on behalf of the petitioner for early listing of the criminal misc. petition is considered and allowed.

With the consent of the parties, the matter is finally heard and decided today itself.

This criminal misc. petition under Section 482 Cr.P.C has been filed by the petitioner essentially with a prayer to direct the police authority to conduct proper investigation in the missing persons report No.86/2017 filed by him on 26.11.2017 at Police Station Pratap Nagar, District Jodhpur, wherein it is alleged that his son-Naresh is missing since 26.11.2017 and his whereabouts

are not known, therefore, he may be traced out.

Learned Public Prosecutor has submitted that now the petitioner has filed an FIR at Police Station Dev Nagar, District Jodhpur with the allegation that five accused persons namely Satish Banjara, Reena, Dimple, Ravi Banjara and Ganpat Banjara had abducted his son and murdered him. It is informed that FIR No.28/2018 of Police Station Dev Nagar, District Jodhpur is registered against the persons named in it for the offences punishable under Sections 364, 302 and 120-B of IPC and the investigation is going on.

In view of the fact that the petitioner himself has filed an FIR alleging that the persons named in it had murdered his son, I do not find any reason for issuing further directions in this criminal misc. petition. Hence, this criminal misc. petition is dismissed.

However, the officer who is investigating into the allegation levelled in the FIR No.28/2018 at Police Station Dev Nagar, District Jodhpur is directed to conduct fair and impartial investigation with utmost expedition.
