This is the second bail application on behalf of accusedpetitioner facing trial in Criminal Regular Case No.164/2018 pending before Additional Sessions Judge No.2, Hanumangarh for offence punishable under Sections 395, 397, 120-B IPC.

The edifice of the aforesaid Sessions Case is FIR No.480/2017 registered at Police Station Pilibanga, Hanumangarh.

On behalf of petitioner, first bail application bearing No.2053/2018 was filed but the same was dismissed on 21.03.2018.

It is submitted by learned counsel for the petitioner that so far only four witnesses are examined during trial whereas prosecution has cited thirty eight witnesses. It is also submitted by learned counsel that there is no recovery from the petitioner

and he is in custody since 05.09.2017. Learned counsel has further argued that completion of trial is likely to take considerable time, therefore, the petitioner may be enlarged on bail.

Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed this second bail application in unison.

Having regard to the facts and circumstances of the case, while refraining to make any comment on merits of the case, I deem it just and appropriate to grant indulgence to the petitioner by enlarging him on bail.

Accordingly, this second bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner, Naveen Kumar S/o Rajendra Kumar, arrested in connection with F.I.R. No.480/2017, Police Station Pilibanga, District Hanumangarh, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two sureties of like amount to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
