This third bail application under Section 439 Cr.P.C. is laid by petitioner in connection with an FIR, wherein he is charged for offences punishable under Sections 323, 325, 364, 384, 394, 307 read with Section 120-B IPC.

Learned counsel for the petitioner submits that co-accused Surendra @ Sunder has already been enlarged on bail by a Coordinate Bench on 30.07.2018, while deciding S.B. Criminal Misc. Bail No.1732/2018, and the case of present petitioner is on better footing to the case of co-accused Surendra @ Sunder.

Learned Public Prosecutor as well as learned counsel for the complainant have opposed the bail application.

Having heard learned counsel for the parties and taking into account facts and circumstances of the case, without expressing

any opinion on merits of the case, I deem it just and appropriate to grant indulgence to the petitioner by enlarging him on bail.

Accordingly, this third bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner, Hanuman Singh S/o Kalyan Singh, arrested in connection with F.I.R. No.122/2013, Police Station Kudi Bhagtasni, District Jodhpur, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
