Petitioner has filed this 3^rd petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No.299/2017 registered with Police Station Malarna Dungar, District Sawaimadhopur for offence under Sections 304, 301 Indian Penal Code, 1860.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 29.12.2017. Co-accused have been granted bail by this court. PW Hari Mohan has not supported the prosecution case, during trial. Complainant (PW3) in his cross-examination, has stated that he had moved an application before the electricity department seeking compensation on the ground that his uncle had died on account of negligence of the electricity department. The property-in-question was owned by petitioner and co-accused

kadu. So far as, co-accused Kadu is concerned, he has been granted bail by this court.

Learned state counsel has opposed the petition.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioner on bail & without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to satisfaction of the Trial Court.
