Petitioner has filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No.24/2017 registered at Police Station Kasbathana District Baran for offences under Sections 384 and 379 of Indian Penal Code, 1860 and later on 392, 397 and 120-B of Indian Penal Code, 1860 was added.
Learned counsel for the petitioner has submitted that the petitioner is in custody for the last 15 months. Co-accused have been granted bail by Co-ordinate Bench of this Court. Petitioner is not involved in any other criminal case.
Learned State counsel has opposed the petition.
Since, Co-accused have been granted bail by Co-ordinate Bench of this Court, on the ground of parity and without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of the Trial Court.
