Petitioner has filed this bail application under Section 438 of Cr.P.C.

F.I.R. No.467/2017 was registered at Police Station Chomu, District Jaipur for offence under Sections 420, 406 I.P.C.

It is contended by the counsel for the petitioner that the petitioner lodged FIR against the complainant with regard to the cheques which were with him and were given with regard to loan taken by the petitioner through complainant. To counter-blast the said FIR present FIR has been lodged alleging that the petitioner has given a cheque having many corrections. It is contended that the petitioner is not required for custodial interrogation and no recovery is to be effected from the petitioner.

Learned Public Prosecutor has opposed the bail application.

I have considered the contentions.

Considering the contention of the counsel for the petitioner the Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Chomu, District Jaipur in F.I.R. No. 467/2017, is directed that in the event of arrest of the petitioners they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to his satisfaction on the following conditions:-

(I). that the petitioners shall make themselves available for interrogation by a police officer as and when required;

(ii). that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or any police officer, and

¶22

(iii). that the petitioners shall not leave India without previous permission of the Court.
