Petitioner has filed this bail application under Section 439 of Cr.P.C.

F.I.R. No. 137/2017 was registered at Police Station Manoharpur District Jaipur (Raj.) for offence under Sections 420, 406, 467, 468, 471, 120-B of I.P.C.

It is contended by counsel for the petitioner that time be given to the petitioner to repay the ICICI bank loan amount.

Learned Public Prosecutor has opposed the bail application. His contention is that petitioner has produced fake Jamabandi and report of Patwari for obtaining ICICI loan amount to the tune of

Rs.7.5 Lacs.

I have considered the contentions.

Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the bail application.

This bail application is accordingly allowed subject to the condition that petitioner will pay the entire ICICI loan amount with interest within a period of three months from today, failing which the bail application shall stand dismissed without reference to the Bench and police would be free to arrest the petitioner and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so and shall give an undertaking before the Court below that he would deposit the laon amount with interest.
