Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No.96/2017 registered at Police Station Anti-Corruption Bureau, Jaipur (Chowki Alwar) for offence under Sections 7 of Prevention of Corruption Act, 1988.

On 29.10.2018 following order was passed by this court:-

“Learned counsel for the petitioner has submitted that the petitioner had already submitted negative final report on 08.02.2018 and the same has been accepted by the Station House Officer on 09.02.2018. Thereafter, on 12.02.2018 there was no occasion to the petitioner to have demanded bribe from the complainant.

List again on 03.12.2018. In the meantime, in the event of arrest, petitioner

be released on interim bail subject to the satisfaction of the Arresting Officer. Petitioner shall abide by the conditions envisaged under Section 438(2) Code of Criminal Procedure, 1973."

Learned State counsel has submitted that the presence of the petitioner is required only for the purposes of presentation of challan.

Accordingly, without expressing any opinion on merits of the case, this petition is disposed of with a direction that in case petitioner surrenders before the concerned court within ten days from today, he be released on bail subject to the satisfaction of the said court.
