Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No. 217/2016 registered at Police Station Anti Corruption Bureau, District Jaipur for offence under Section 7, 12, 13(1)(D), 13(2), 14 of Prevention Of Corruption Act, 1988 and Section 120-B Indian Penal Code, 1860.

Learned counsel for the petitioner has submitted that the petitioner has been falsely involved in this case. Petitioner has already joined investigation and has co-operated with the Investigating Agency. Petitioner was working as an Executive Director, Human Resources. Traps were organized by the Anti Corruption Bureau at Jaipur. However, the said traps had failed and the petitioner was not in Jaipur at that time. Petitioner had resigned from the company in October, 2016.

Learned State counsel has opposed the petition and has submitted that FIR in the present case was registered in July, 2016. Officials of SPML Infra Limited company were indulging in corruption with regard to the projects undertaken by them. Mobile-phones of the senior officers of the company were intercepted, after following due process of law, and their conversations were recorded. From the telephonic conversation, it was evident that senior officers of the Public Health and Engineering Department were being bribed through Aakash Deep Totla. Various projects were entrusted to the company and during implementation of the said projects, bribe money was paid by the officials of the company (including the petitioner) to the Government officials who were holding responsible posts. Petitioner is required for custodial interrogation. Petitioner was the Executive Director of the company-in-question. Anticipatory bail petition filed by similarly situated co-accused Keshav Gupta was dismissed by this Court vide order dated 14.05.2018.

Since in the present case, anticipatory bail petition filed by similarly situated co-accused Keshav Gupta was dismissed by this Court and the seriousness of allegations levelled against the petitioner, this petition is also liable to be dismissed.

Accordingly, this petition is dismissed.
