The present Misc 2^nd bail application under section 439 Cr.P.C. is preferred by the Accused/petitioners in the matter of FIR No. 345/2016 registered at Police Station Khairthal, District Alwar, for offences punishable under Sections 394, 397 of IPC and 3/25 Arms Act.

Learned counsel for the petitioner submits that earlier bail application of the present petitioner was dismissed by this Court on 5.7.2017, thereafter more than one year has been passed the trial has not been completed yet, he submits all the looted amount has almost recovered and trial will take time, therefore, petitioner may be released on bail.

Learned Public Prosecutor opposed the 2^nd bail application.

Having regard to submissions made by the learned counsel

for the petitioner specially considered fact that accused-petitioner

is behind bars since 5.11.2016 and trial has not been completed yet and looted amount has already been recovered, I am inclined to grant benefit of bail to the accused-petitioner.

Consequently, the 2^nd bail application filed under Section 439 Cr.P.C. is allowed.

Therefore, it is ordered that the accused-petitioner Parvej @ nasir Hussain S/o Shri Sanwat Khan @ Shah Mohammad in FIR No. 345/2016 registered at Police Station Khairthal, District Alwar, shall be released on bail; provided he furnishes a personal bond of Rs. 1,00,000/- and two surety bonds of Rs. 50,000/- each to the satisfaction of the learned trial court with the stipulation to appear before the Trial Court on all dates of hearing and as and when called upon to do so.
