Petitioner has filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 171/2018 registered at Police Station Laxamangarh for offence under Sections 376D and 366 of Indian Penal Code, 1860 and Section 67 of Information Techonolodgy Act, 2000 and Section 4/6 of Indecent Representation of Women (Prohibition) Act, 1986.
Learned counsel for the petitioner has submitted that the petitioner is in custody since 23.05.2018. Challan has already been presented in the Court and conclusion of trial may take time. From the statements of the prosecutrix recorded under Section 161 and 164 Code of Criminal Procedure, 1973 (hereinafter referred as ‘Cr.P.C.’), it is evident that she had been raped by coaccused Bablesh. Prosecutrix has stated in her statement under Section 164 Cr. P.C. that co-accused Bablesh has ruined her life.

Learned State counsel has opposed the petition and has submitted that the petitioner is specifically named in the FIR. Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioner on bail.
Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to satisfaction of the Trial Court.
