Accused-petitioners have laid these second bail applications under Section 439 Cr.P.C. arising out of same FIR bearing registration No.107/2017, registered at Police Station Kalinjara, District Banswara, for offence under Sections 147, 149, 341, 323, 342, 354B, 355, 357 & 120B IPC.

On behalf of petitioners, first bail application was rejected on 16.08.2017.

Pressing this second bail application, it is submitted by learned counsel that after rejection of first bail application of petitioners, co-accused, viz., Govind S/o Sh. Gautam Maida, Sharma S/o Valji Maida, Gautam S/o Punja Maida, Naku S/o Deva Maida, Heera S/o Deva Maida and Mani Lal S/o Pachu Ninama, have granted bail by this Court on 27.09.2018 while deciding S.B. Criminal Misc. Bail No.8955/2018. It is also argued by learned counsel that case of petitioners are at par with case of the coaccused, therefore, petitioners may also be granted indulgence.

Per contra, learned Public Prosecutor has opposed this second bail applications of petitioners.

I have bestowed my consideration to the arguments advanced at bar.

Having regard to the facts and circumstances of the case, without expressing any opinion on merits of the case, I feel persuaded to accept these second bail applications.

Accordingly, these second bail applications under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioners, (1) Gang Ji S/o Kalu Ninama, and (2) Narain S/o Punja Katiza Bheel, arrested in connection with F.I.R. No.107/2017 of Police Station Kalinjara, District Banswara, may be released on bail; provided each one of them furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
