Harimohan Son of Shri Nathua, by Caste Mali Vs State of Rajasthan through P.P.

Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No.91/2015 registered at Police Station Mahila Thana, Karauli for offence under Sections 498A and 406 of Indian Penal Code, 1860.

Present FIR is an outcome of matrimonial discord between the parties. On 18.08.2018 following order was passed by this court:-

"List again on 10.09.2018. In the meantime, in the event of arrest, petitioner be released on interim bail subject to the satisfaction of the Arresting Officer. Petitioner shall abide by the conditions envisaged under Section 438(2) Cr. P.C."

Learned state counsel has submitted that in pursuance to the above order, petitioner has joined investigation and is not required for further investigation.

Accordingly, without expressing any opinion on merits of the

case, interim bail granted by this Court to the petitioner vide order dated 18.08.2018, is made absolute.
