Petitioners have filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 97/2018 registered at Police Station Purani Tonk, Distt. Tonk, for offences under Sections 341, 323, 324, 307, 326 of Indian Penal Code, 1860.

Learned counsel for the petitioners has submitted that the parties are closely related to each other. Present FIR is an outcome of matrimonial discord between the parental uncle of the petitioners with his wife. Petitioners are in custody since

29.07.2018. Challan has already been presented in the Court and conclusion of trial may take time.

Learned State Counsel who is assisted by the counsel for the complainant has opposed the petition.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioners on bail.

Accordingly, without expressing any opinion on merits of the case, this petition is allowed. Petitioners be admitted to bail subject to satisfaction of the Trial Court.
