Counsel for the applicant has referred to the statement of Inder Mohan(PW.1) and Alok Sharma(PW.2) to contend that right from lodging of the FIR till statements made by the witnesses in the court and the statement of accused-respondents recorded under Section 313 Cr.P.C, case of the prosecution is that the accused-respondents had committed theft of Iron Nets(Jali), Iron bars(Sariya). Counsel for the applicant contends that it was nowhere case of the witnesses of the prosecution that accusedrespondents had damaged the pipe or had removed the plaster, bricks or the stones.
After hearing counsel for the applicant, application for leave to appeal is granted.
Registry is directed to register and assign number to the proposed appeal and the same shall be deemed to have been admitted.
