Appellants have preferred this criminal appeal aggrieved by order dated 12.10.2018 passed by Special Judge, SC/ST (Prevention of Atrocities) Act Cases, Karauli, whereby the Court below has taken cognizance against the accused appellants for the offence under Sections 341, 323, 348 of I.P.C. and Sections 3(1) (c) (s) (r) (2) (va) of the SC/ST (Prevention of Atrocities) Act and has issued arrest warrants.

It is contended by counsel for the appellants that Police submitted a negative final report. Court below has taken cognizance and summoned the appellants by arrest warrants.

Counsel for the appellants has placed reliance on 2008(1) WLC (SC) Criminal, “Indermohan Goswami & Anr. Vs. State

I have considered the contentions.

Considering the contentions put forth by counsel for the appellants also considering the fact that a limited prayer is made that the arrest warrants be not executed as appellants are ready to appear before the Court, I deem it proper to partly allow the present criminal appeal.

Appellants are directed to appear before the concerned Court within ten days and submit bail bonds, as deemed proper by the trial Court. Court below shall not execute the arrest warrants.

Stay application stands disposed.
