appellant had filed an he award whereby his claim petition was dismissed and the case was remanded to the Tribunal for a fresh decision after re-enquiring the matter with regard to the accident. On re-enquiry, police had furnished the report that the accident as alleged had taken place. Challan has been presented against respondent No. I.
Appellant had filed the claim petition seeking compensation on account of injuries suffered by him in the motor vehicle
accident, which had occurred on 05.02.2006 due to rash and negligent driving of respondent No.1 while driving the offending Jeep. It is the case of the appellant that he was travelling in offending Jeep and its driver was driving the vehicle in a rash and negligent manner and had struck against a stationary vehicle.
