The petitioner-Plaintiff (hereinafter `the plaintiff') is aggrieved of
the order dated 13-7-2017 passed by Senior Civil Judge Dudu dismissing
his application under Order 39 Rules 1&2 CPC, as also the affirming order
dated 23-9-2017 in the civil miscellaneous appeal passed by the
Additional District Judge camp court Dudu District Jaipur.

After arguing for a while counsel for the plaintiff-applicant on
instructions, submits that the petitioner would be satisfied in the event the petition is disposed of with a direction to the trial court to dispose of the underlying suit for declaration, customary easement
and mandatory permanent injunction within a period of six months.
In view of submissions of counsel for the petitioner, the trial
court is directed to dispose of the underlying suit expeditiously, and
as far as possible within a period of six months from the date next
fixed before it.
Petition stands disposed of accordingly.
