This parole writ petition has been filed by the petitioner being aggrieved with the order dated 29.04.2016 passed by the District Collector, Sirohi, whereby while ordering to release the petitioner on second parole of 30 days, a condition has been mentioned that he will furnish two sureties of Rs. 25,000/- each along with personal bond of Rs. 25,000/-. It is contended that petitioner is a poor person and is not able to arrange for the sureties and, therefore, he may be released on second parole of 30 days on his personal bond only. It is further contended that this Court in S.B. Civil Parole Writ Petition No. 9579/2014 has ordered for releasing the petitioner on parole on furnishing personal bond of him only. It is further submitted that after expiry of the first parole period, the petitioner has surrendered before the jail authorities in time.

Learned counsel for the petitioner has therefore prayed that the petitioner be directed to be released on 30 days parole on furnishing personal bond only.

Learned Public Prosecutor has opposed this parole writ petition, however, he is not in a position to dispute the fact that earlier this Court issued a direction for releasing the petitioner on first parole of 20 days on furnishing personal bond only.

Accordingly, this parole writ petition is allowed and it is hereby directed that the convict-Jitendra @ Jeetu, who is presently lodged in Central Jail, Jodhpur shall be released on second parole for a period of 30 days in pursuance to the order dated 29.04.2016 upon furnishing his personal bond in the sum of Rs. 50,000/- only to the satisfaction of the Jail Authorities and the respondents shall not insist on furnishing sureties.

The convict-Jitendra @ Jeetu shall surrender himself before the Jail Authority after availing 30 days’ parole from the date of his release.

The order dated 29.04.2016 passed by the District Collector, Sirohi is modified accordingly.
