10.10.2014. While returning, he heard shouts of thief emanating from the house of Arjundan. Bhagirath joined the villagers in the thief’s pursuit which proved unfruitful. Later on, Arjundan, Amardan, Babudan, Prabhudan, Daaldan, Surendradan and Bhagrithdan came to the complainant’s house and asked for Manoj Kumar. The complainant replied that Manoj Kumar was sleeping. The accused inspected clothes of Manoj Kumar for sand, thorns, etc. suspecting that he might have committed the theft at Arjundan’s house. Bhagirath told them that Manoj Kumar could not have indulged in the alleged theft because he was present in the house all along. The accused persons called Bhagirath to their house at about 09.30 pm. and hurled insinuations that Manoj Kumar was the thief. Bhagirath denied their allegations. The accused party again came to the complainant’s house and started assaulting Manoj Kumar. The complainant and Bhagirath requested them not to do so but the accused did not relent. They forcibly dragged Manoj Kumar to their house. At that time, Prabhudan was in an intoxicated state and was threatening that Manoj Kumar would not be left alive. The complainant’s sons Bhagirath and Gauri Shanker kept waiting outside the house of Prabhu Dan till 11 O ‘Clock’ requesting the accused party to release Manoj Kumar but the accused stated that, Manoj Kumar would only be left after interrogation or that he would be handed over to police. It was further alleged that the complainant’s family was the only one of their caste in the village dominated by Charans who were indulged in offensive activities and were terrorising the complainant’s family.
