Petitioner has filed this petition under Section 397 read with Section 401 Code of Criminal Procedure 1973 challenging the order dated 3.3.2017, whereby charges were ordered to be framed against the petitioner.
I have heard the learned counsel for the petitioner, learned Public Prosecutor and have gone through the record available on the file carefully.
In the present case, petitioner and his coaccused were apprehended while making preparation for commission of offence of dacoity. Accused were armed with weapons. A revolver alongwith live cartridges were recovered from the petitioner, whereas from the co-accused Bhim Singh, one Carbine loaded with Magazine and live cartridges were
recovered. From co-accused Shivraj, a pistol and live cartridges were recovered.
Keeping in view the recoveries effected from the accused, who were apprehended at the spot, learned trial court has rightly ordered framing of the charges against the accused under Section 120-B, 399, 402, IPC and Section 3/25, 7/25(1)(AA) of the Arms Act, 1959.
No ground for interference by this court is made
out.
