The petition is preferred under Section 482 of the Cr.P.C. to quash FIR No.415/2016 registered at Police Station Gumanpura, District Kota City registered against the Petitioner under Section 420, 406 and 120 IPC.

The Court has carefully perused the record of the case. It has been pointed out by the Learned Public Prosecutor that a decision has been taken on 28.12.2016 to file a chargesheet against the Petitioners.

Learned counsel for Petitioner states that though the investigation is complete but the same is without taking into

consideration certain documents which the Petitioner wanted the investigating agency to consider.

After hearing the counsel for parties, this Court deems it appropriate to direct the Superintendent of Police, District Kota City who has passed the order dated 28.12.2016 giving approval to the proposed chargesheet to take into consideration any document submitted by the Petitioner within the next five days. The officer with the help of the Investigating Agency functioning under him shall ensure that such version of documents so preferred by the Petitioner shall be considered strictly in accordance with law before proceeding further with the case.
