Instant petition has been filed under section 482 Cr.P.C. praying interalia that the order dated 06.09.2016 passed by Learned Judicial Magistrate, Todabheem, District Karauli in

Criminal Case No. 375/2016 (State of Rajasthan Vs Batasya &Ors) whereby Learned Magistrate dismissed the application of accused/ petitioner submitted under section 70(2) Cr.P.C. for converting warrant of arrest into bailable warrant.

After hearing the Learned Counsel for the parties, the present petition is disposed of by issuing direction to the Court of Learned Judicial Magistrate, Todabheem, District Karauli that nonbailable warrant issued against the petitioner be kept in abeyance upto 10 days to enable the petitioner to surrender and apply for regular bail.

Needless to say, the application for regular bail to be filed by the petitioner shall be decided in accordance with the provisions of law uninfluenced by any observations made by this Court in this order.

It is further clarified here that in case the petitioner fails to appear before the Court below within the stipulated period i.e within 10 days from today, the present order shall cease to operate and the law shall take its own course.

Upon disposal of the main petition, the stay application, filed therewith, does not survive ; same is also disposed of.
