Both these petitions have been filed under Sec.482 Cr.P.C. Mr.Laxman Meena, learned counsel for the petitioner wants to withdraw the petition bearing SBCr.Misc.Pet.No.1496/2016.

Accordingly, this cr. Misc. pet. no. 1496/2016 is dismissed as withdrawn.
Mr.Prahlad Sharma, learned counsel appearing in SBCr.Misc. Pet. No.2376/2016 for the petitioners has contended that FIR lodged against the petitioner is contrary to law and hence same is liable to be quashed. It is also contended that no case of cheating is made out against the petitioner. FIR has been lodged after inordinate delay.
On the other hand, Mr.Laxman Meena, counsel for complainant has opposed the same; whereas Mr.RS Shekhawat, PP has submitted the factual report submitted by police, and contended that police after due investigation has come to conclusion that this matter pertains to civil nature and not of criminal case, hence report should be taken on record.
I have heard learned counsel for the parties and perused the entire material available on record including the factual report submitted by police. Operative portion of factual report is reproduced as under:

From the perusal of factual report, as quoted above, it transpires that no criminal case is made out against the petitioner. In fact it is a matter of civil nature and thus nothing survives in this petition and same deserves disposal in the light of aforesaid report.
Accordingly, in view of above, this cr.misc. Pet. No.2376/2016 is disposed of in the light of factual report submitted by police through the Public Prosecutor. Copy of factual report is taken on record.
