This petition has been filed under Section 482 CrPC for quashing and setting aside the order dated 3.11.2016 passed by Addl. District and Sessions Judge No. 17, Jaipur Metropolitan City, Jaipur in Cr. Revision No. 40/2013 as well as for quashing and setting aside the order dated 24.10.2013 passed by Addl. Chief Metropolitan Magistrate (Communal Riots), Jaipur Metropolitan in Complaint No. 703/2012.

Learned counsel for the petitioner has made the following limited prayer :

I) That the matter is very old; number of persons have been retired; and number of persons are suffering from oldness disease. In

such circumstances, if they move an application for permanent exemption from personal appearance or exemption from appearance on particular date, as the case may be, the learned trial court may be directed to consider their application regarding exemption from their personal appearance.

II) If they move any application in the light of the judgment delivered by the Addl. District & Sessions Judge on 3.11.2016, the same should be decided by the Court below in accordance with law.

III) If the petitioner does not satisfy with the order of the learned trial court, in such circumstances, liberty should be given to him to move a fresh petition under Section 482 CrPC.

Learned PP has opposed the same.

The limited prayer of the counsel for the petitioner seems to be genuine. Hence, I order accordingly.

The Cr. Misc. Petition as well as the stay application, both stand disposed of accordingly.
