Both the bail applications are filed under Section 439 Cr.P.C. on behalf of the petitioners Rajesh Bhudhar Bhai and Dakshes Ragji Patel, who are in custody in connection with F.I.R. No.34/2017 Police Station PBIM & H, Jaipur, for the offences under Section 4,5,6,23,25 and 29 of the PCPNDT Act, 1994 and Rule 9 and 10 of the PCPNDT Rules, 1996 and Section 315/511, 120B of IPC.

Heard learned counsel for the petitioner and learned Public Prosecutor.

It is submitted by the learned counsel for the applicants that the applicants were arrested in connection with the offences under Section 4,5,6,23,25 and 29 of the PCPNDT Act, 1994 and Rule 9 and 10 of the PCPNDT Rules, 1996 and Section 315/511, 120B of IPC and after investigation, they are in judicial custody and no investigation and recovery is required to be made from the applicants, therefore, they may be released on bail.

Learned Public Prosecutor vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced at the bar, this Court is of the opinion that the bail applications filed by the petitioners deserves to be accepted.

Consequently, the both the bail applications are allowed. It is ordered that the accused-petitioners (i) Rajesh Bhudhar Bhai S/o Sh. Bhudhar Bhai and (ii) Dakshes Ragji Bhai Patel S/o Sh. Ragji Bhai Patel arrested in connection with F.I.R. No.34/2017

Police Station PBIM & H, Jaipur shall be released on bail; provided they furnishe personal bonds of Rs.50,000/- each and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
